Spectate — Terms of Use (End User License Agreement)

These Terms of Use ("Terms" or "EULA") govern your use of the Spectate mobile application ("Spectate," the "App," "we," "us," or "our"), published by Spectate Pty Ltd (ABN 19 685 630 059), a company registered in Western Australia, Australia.
By downloading, installing, accessing, or using the App, you agree to be bound by these Terms. If you do not agree, do not use the App.
1. The agreement and the parties
This EULA is a binding agreement between you and Spectate Pty Ltd. Where you download the App from the Apple App Store, you acknowledge that this agreement is concluded between you and Spectate Pty Ltd only, and not with Apple Inc. Apple is not responsible for the App or its content. Where you download the App from the Google Play Store, your use is also subject to the Google Play Terms of Service.
2. Licence
We grant you a personal, limited, non-exclusive, non-transferable, revocable licence to download and use the App on any Apple or Android device that you own or control, in accordance with the usage rules of the applicable app store and these Terms. This licence is for your personal, non-commercial use only. You may not copy, modify, reverse-engineer, redistribute, sublicense, or create derivative works from the App except as permitted by law.
3. Subscriptions and auto-renewal
Spectate offers an auto-renewing premium subscription that unlocks additional features.
Subscription options:
Monthly — US$2.99 per month (or local equivalent)
Yearly — US$24.99 per year (or local equivalent), approximately US$2.08 per month billed annually
Current pricing is always displayed in the App before purchase and may vary by region and currency.
How billing works:
Payment is charged to your Apple Account or Google Play account at confirmation of purchase.
Your subscription automatically renews unless auto-renew is turned off at least 24 hours before the end of the current period.
Your account is charged for renewal within 24 hours prior to the end of the current period, at the rate of the subscription you selected.
You can manage your subscription and turn off auto-renewal at any time after purchase in your account settings — in the App Store (iOS) or Google Play (Android). Deleting the App does not cancel your subscription.
Any unused portion of a free trial period, where offered, is forfeited when you purchase a subscription.
Refunds are handled by Apple or Google in accordance with their respective store policies, and not by us directly.
4. Privacy
Your use of the App is also governed by our Privacy Policy, available at https://justspectate.com/privacy-policy, which explains how we collect, use, and protect your information.
5. Sports data and content
Spectate provides sports information, statistics, fixtures, odds-derived probabilities, and editorial content sourced from third-party data providers. This content is provided for informational and entertainment purposes only. We do not guarantee the accuracy, completeness, or timeliness of any data, and you should not rely on it for betting, financial, or other decisions. Any probability or odds-derived visualisations are illustrative and are not predictions, advice, or an invitation to gamble.
6. Acceptable use
You agree not to use the App to: break any law; infringe anyone's rights; interfere with or disrupt the App or its servers; attempt to gain unauthorised access to any systems; or scrape, harvest, or resell content or data from the App.
7. Maintenance and support
Spectate Pty Ltd is solely responsible for providing any maintenance and support for the App. Apple and Google have no obligation to provide any maintenance or support services. You can reach us at hello@justspectate.com.
8. Warranties and consumer rights
To the maximum extent permitted by law, the App is provided "as is" and "as available" without warranties of any kind, whether express or implied.
Australia: Nothing in these Terms excludes, restricts, or modifies any consumer guarantee, right, or remedy under the Competition and Consumer Act 2010 (Cth), including the Australian Consumer Law, that cannot lawfully be excluded. Where our liability for breach of such a guarantee can be limited, it is limited to resupplying the App or paying the cost of resupply.
United Kingdom and other regions: You may have statutory rights as a consumer (for example under the Consumer Rights Act 2015 in the UK) that these Terms do not affect.
In the event the App fails to conform to any applicable warranty, you may notify Apple, and Apple may refund the purchase price (if any). To the maximum extent permitted by law, Apple has no other warranty obligation with respect to the App.
9. Limitation of liability
To the maximum extent permitted by law, and subject to your non-excludable statutory rights, Spectate Pty Ltd is not liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, data, or goodwill, arising from your use of or inability to use the App.
10. Intellectual property
All intellectual property rights in the App — including its software, design, branding, "Spectate" name and logos, and editorial content — are owned by or licensed to Spectate Pty Ltd. These Terms grant you no rights in our intellectual property except the limited licence in section 2.
11. Product claims and legal compliance
Spectate Pty Ltd, and not Apple or Google, is responsible for addressing any claims relating to the App, including product liability claims, claims that the App fails to conform to legal or regulatory requirements, and claims arising under consumer protection or similar legislation.
You represent that you are not located in a country subject to a relevant government embargo and are not on any government list of prohibited or restricted parties.
12. Third-party terms and beneficiary rights
You must comply with any applicable third-party terms when using the App (for example, your wireless data plan terms). You acknowledge and agree that Apple Inc. and its subsidiaries are third-party beneficiaries of this EULA, and that upon your acceptance, Apple has the right (and is deemed to have accepted the right) to enforce this EULA against you as a third-party beneficiary.
13. Changes to these Terms
We may update these Terms from time to time. Material changes will be notified in the App or by other reasonable means. Continued use of the App after changes take effect constitutes acceptance of the revised Terms.
14. Termination
We may suspend or terminate your access to the App if you breach these Terms. You may stop using the App at any time. Sections that by their nature should survive termination (including intellectual property, limitation of liability, and governing law) will survive.
15. Governing law
These Terms are governed by the laws of Western Australia, Australia, and you submit to the non-exclusive jurisdiction of the courts of Western Australia. This does not deprive you of the protection of any mandatory consumer laws of the country in which you reside.
